A personal injury lawyer or a personal injury attorney is usually blamed for the increased cost of a lot of things. Tim Collard even blogged: “Personal Injury Lawyers be damned. Let’s pass a Stuff Happens Act.”
People say that personal injury lawyers cause a lot of personal injury lawsuits. These personal injury lawsuits increase insurance costs, among others, which ultimately makes the end-product or service expensive.
There will always be some personal injury lawyers or injury attorneys who will seek out victims of car accidents or slip and fall accidents. These injury lawyers would then offer to handle the victim’s case even if it is clearly not worth pursuing. The offer is attractive—no attorney’s fee unless the case is won. Measures should be put in place to prevent these ambulance chasers.
But, not all personal injury attorneys are like that; And, imagine a world where there are no personal injury lawyers or where legislation makes it difficult to institute personal injury claims. Companies would be more lax about their product’s quality and safety to cut costs and increase profits. More accidents would then happen. I’m sure nobody wants that.
Personal injury lawyers should not be blamed for these rising costs. After all, the defendants are also allowed to hire their own accident lawyer or slip and fall lawyer to protect their interests and dispute the claims against them whether it be personal injury claims or accident claims. So, if somebody sues for personal injury claims, they can dispute such claims. It’s not as if personal injury lawyers could automatically make them liable without a chance of defending themselves. Unless they really are guilty of negligence, that is.
